Your use of the ESSI Money website is subject to the terms and conditions set out below (“Terms”).

“You” are the user of the website;

“Website” or “Site” is the website that you are currently using, and includes www.financialbasics.org.au and www.essimoney.com.au, but does not include websites to which either website has links;

“Content” is the content of these websites that is visible through use of a web browser.

“Sponsor” is a third party with which the FBF has entered into a business arrangement involving the negotiated provision of funds, goods or services in exchange for advertising, publicity or other benefits.

“Teacher Resources” are resources provided on this Site by FBF as part of the content of these websites for the use of Teachers in an educational forum.

“School Syndicate” are the users of this site that are registered, as a group, by their teacher/educator, to play ESSI Money as part of a structured lesson plan.

www.essimoney.com.au (the "Site") is owned and operated by the Financial Basics Foundation, ABN 90 114 612 271 and may contain material from Financial Basics Foundation and other related companies , including ESSI Money Pty Ltd ACN (collectively, “FBF”). Your access to, use of, linking to the Site, use of software or downloading software on the Site including the Teacher Resources and Curriculum Mapping PDF files on the Site (collectively, your “Access”) is conditional upon your acceptance and compliance with the terms, conditions, notices and disclaimers contained on this page and elsewhere on the Site ("General Conditions"). Your Access to the Site constitutes your agreement to be bound by the General Conditions. FBF reserves the right to amend the General Conditions at any time.

The entire content included on this Site, including without limitation all information, text, materials, graphics, software, tools, results derived from the use of software and tools, advertisements, names, logos and trade marks on the Site ("Content") are the property of FBF and are protected by copyright, trade mark and other intellectual property laws unless expressly indicated otherwise on the Site. You must not modify, copy, reproduce, republish, frame, download onto a computer, upload to a third party, post, transmit or distribute this Content in any way except as expressly provided for in these General Conditions or with the express prior written consent of FBF.

FBF may consent to the use of such tools for Content made available on the Site for personal and educational purposes and not commercial purposes. If such consent is provided it must be in writing and may contain or be subject to any particular terms and conditions required by FBF.

You must not use any spider, screen scraper, robot, or other automated similar software or device ("Prohibited Device") to use or access the Site in any way whatsoever, nor can you use any Prohibited Device (or any similar process) to copy, download or monitor the Content, without FBF’s prior written approval. Search engines may access and index content on the Site provided that they obey the Robots Exclusion Standard and exclude documents with METATAG markings designed to preclude access including indexing, archiving or caching. The trademarks listed below unless indicated otherwise, are trade marks of FBF. Where a mark is indicated as a registered mark it is registered in Australia and may also be registered in other countries. Nothing contained on the Site should be construed as being any licence or right of use of any trade mark displayed on the Site.

ESSI Game

Right to Access and Use of the Site

You may view the Site using your web browser and save an electronic copy, or print out a copy, of parts of this web site solely for your own personal use, information, research or study, but only if you keep all Content intact and in the same form as presented on the Site (including without limitation all copyright, trade mark and other proprietary notices and all advertisements).

You must not use the Site or the Content in any manner or for any purpose which is unlawful or in any manner which violates any right of FBF or which is prohibited by these General Conditions.

You must not use the Content for commercial purposes without first obtaining the express written authority of FBF. Use of the Content for a commercial purpose is any use other than accessing and using the content for your own personal and private decision making or educational purposes.

Harassment in any form on the site, including via email, chat, feedback, reviews or by use of obscene or abusive language, is strictly forbidden. You may not upload to, distribute, or otherwise publish through the site any content which is libellous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offence, violate the rights of any party or which may otherwise give rise to liability or violate any law. Data collected through the registration process for this Site is used for the purpose of:

(a) sending confirmation notice to the user of the registration
(b) upon the user’s request, to send the user password information when the user has lost or forgotten the password
(c) in response to any questions, concerns or problems that the user contacted FBF about
(d) to contact the user about any problem with the user’s conduct on our site
(e) to send out a newsletter*
(f) to publish the names of winners or outstanding student achievement on our website or in the newsletter
(g) to send prizes or certificated for participation and performance
(h) informing registered users of updates to the Site
(i) tracking the level and range of interest in FBF initiatives
(j) determining usage patterns in order to improve the service or develop new services
(k) managing user groups

*FBF designs and runs numerous special events that keep the site and our resources constantly fresh, challenging, fun and interesting for our users. We use the newsletter to notify our users of all the current events, changes, improvements, upgrades, new products and services.

FBF uses its best endeavours to comply with the National Privacy Principles in the Privacy Amendment (Private Sector) Act 2000. We have chosen not to provide students with any means to communicate directly between each other. There are no chat rooms connected with the learning resources.

Collection of Personal Information

The main way we would collect personal information from you is if you used our site to register for resources or to subscribe to another FBF service. This personal information may include your full name, student names, phone and fax numbers, e-mail address and street and postal address.

When or before we collect personal information on our web site, we will take reasonable steps to inform you of:

(a) the purposes for which the information is collected;
(b) where applicable, any law that requires the particular information to be collected; and
(c) the main consequences for you if all or part of the information is not provided.

Personal Information Quality

When you provide personal information to us via the Internet, we rely on the accuracy of that information. To assist with ensuring accuracy, please contact us if any of the details you have provided change. We will correct the information if we are satisfied it is incorrect.

Use and Disclosure of Personal Information

We will only use your personal information (including your e-mail address) for the purpose for which you have provided it, eg to register for an on-line FBF game, unless you consent otherwise. We may also from time to time email you about an event or new feature that we think might be of interest. If you do not wish to receive such emails, all you have to do is hit the reply button and type "remove" in the subject field of the email.

A strategy to ensure that FBF and our initiatives are as engaging as possible to students, is to publicly display student names on the website and in the newsletter. FBF will NOT display full names publicly (i.e. First Name and Surname).

Displaying first names makes the experience more real and provides a greater sense of achievement. We appreciate that schools and parents might prefer that their students/children do not have their first name shown. Teachers are able to choose the setting for the public display of names as either:

(a) First Name, Surname initial (e.g. Jessica S)
(b) Initials of First Name and Surname (e.g. JS)

We will not disclose your personal information to third parties, unless you consent or in other circumstances where such disclosure is required or authorised by law.

Contracts we enter into with other parties for the provision of services may require us to disclose sections of your personal information to them. In those cases, our contracts require other parties providing services to us to observe the terms of this Privacy Statement.

Sensitive Information

We do not collect sensitive information such as your racial or ethnic origin, political opinions or religious beliefs.

Collection of Click Stream and other information

When you look at this web site our server logs the following information, which is provided by your browser. This information is logged for statistical purposes only:

(c) To manage advertising on the Site; and

Registering to Play ESSI Money

Terms and Conditions

Please read the Terms and Conditions and Game Rules before registering to play ESSI Money.

1. General Conditions

1.1 The developer of ESSI Money (the 'Game') is Financial Basics Foundation Ltd ABN 90 114 612 270 and ESSI Money Pty Ltd ACN both of Level 7, 477 Collins Street, Melbourne 3000 (collectively referred to as “FBF”).
1.2 Participation in the Game is subject to compliance with the General Conditions of the ESSI Money website located at https://www.essimoney.com.au, and the Terms and Conditions of the Game and the Game Rules which are located on the ESSI Money website at https://www.essimoney.com.au ('Game Website'). Students and their teachers ('Coordinating Teacher') should familiarise themselves with the Terms and Conditions and Game Rules prior to making an application to participate in the Game. Completion and submission of an online registration form for the Game will be deemed to be acceptance of the Terms and Conditions and Game Rules, by the relevant students and Coordinating Teacher, and each will be bound accordingly.
1.3 FBF has sole responsibility for the interpretation of the Terms and Conditions and Game Rules and no correspondence into the same will be entered into. FBF reserves the right to amend the Terms and Conditions and Game Rules at any time without notice.
1.4 Coordinating Teachers and participating students acknowledge that the purpose of the Game is for information and educational purposes only and is not intended as investment or financial product advice. Coordinating Teachers and participating students acknowledge that any information supplied in relation to the Game applies only to this Game, and such information should have no bearing on how a person should invest money in the sharemarket or make personal financial decisions. Coordinating Teachers and participating students acknowledge that such information does not constitute advice or recommendation of any financial products and that each should consider obtaining independent advice before making any financial and/or investment decisions.
1.5 Coordinating Teachers and participating students acknowledge that the Terms and Conditions and Game Rules do not necessarily correspond with the actual trading requirements of the ASX market, or any other securities market, or any securities regulatory authorities in Australia or elsewhere.
1.6 Whilst every care has been taken in producing information in relation to the Game, FBF does not make or imply any representation or warranty as to the reliability, accuracy, completeness or suitability of such information. FBF is neither responsible nor liable for any incorrect or inaccurate information or incorrect posting of quotes, whether caused by website users or by any of the equipment or programming associated with or utilised in the Game or by any technical or human error which may occur in the processing of submissions in the Game. To the extent permitted by law, no responsibility for any loss (whether in negligence or otherwise) occasioned to anyone acting or refraining from acting as a result of this information and/or the Game is accepted by FBF.
1.7 FBF is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers or providers, computer equipment or software including but not limited to the failure of a participant's/ School syndicate's email on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to a school's computer, or a student's computer, or to any other person's computer related to or resulting from participating or downloading materials in this Game, or the participant's/ School syndicate's inability, difficulty or failure to access any electronic site.
1.8 If, for any reason, the Game is not capable of running as planned, including without limitation, infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, or any other causes beyond the control of FBF, which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Game, FBF reserves the right in its sole discretion to cancel, terminate, modify or suspend the Game and/or access to the Game at any time by giving notice of the same on the FBF website.
1.9 Coordinating Teachers and participating students release and hold harmless FBF and their directors, officers, employees and agents from any and all liability for any injuries, loss or damage of any kind however caused arising from or in connection with the Game or any prize(s) won.

2. Eligible participants

2.1 The Game is open to participation by any person(s), however, all registrations are subject to final acceptance by the FBF National Development Coordinator ('Game Coordinator'). The Game Coordinator may, in her absolute discretion, reject any registration application.

3. Registration

3.1 Playing the Game is free.
3.2 To register to play the Game, the person(s) and/or the Coordinating Teacher must complete and submit the online registration form ('Registration Form') to the Game Coordinator. The Registration Form is the only means of entering the Game accepted. The Registration Form can be found on the Game Website.
3.3 FBF accepts no responsibility for incomplete, late, lost, corrupted, misdirected, misplaced or destroyed Registration Forms, nor for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or unauthorised access to, or alteration of Registration Forms, whether or not caused by this, or some other factor or factors.
3.4 Coordinating Teachers must provide details of the school's email address (i.e. an address with “edu.au”, ”gov.au”, where indicated on the Registration Form.
3.5 Once the Registration Form is received by FBF, confirmation the application has been successful via a message appearing on the registration screen will be sent to the individual/Coordinating Teacher. The Coordinating Teacher can then print a report detailing each School syndicate name/user name and password. Individual participants and/or School syndicates, as the case may be ("Participant") may login to the Game Website and can access all the pages of the Game.
3.6 FBF reserves the right to limit, at its sole discretion, the number of Participants in the Game at any stage and without prior notice.
3.7 FBF reserves the right to alter any usernames deemed unsuitable, including but not limited to, names that are offensive, defamatory, discriminatory or interfere with a trade mark or other intellectual property right of FBF or a third party.

4. Playing the Game

4.3 FBF may, at any time, deny entry or suspend access to the Game, or disqualify any person(s) from the Game, at any time, without notice. Without limitation, FBF also reserves the right to refuse entry to the Game or disqualify any Participant found to be:
(a) tampering with the entry process, the operation of the Game, FBF website, or the Game Website;
(b) ) engaging in practices which, in the sole opinion of FBF, subverts or is intended to subvert the Terms and Conditions and/or Game Rules;
(c) in breach of the Terms and Conditions and/or Game Rules;
(d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person; or
(e) engaging in any conduct which, in the sole discretion of FBF, is deemed to be contrary to, or in breach of, the spirit of the Game.
4.5 Participants acknowledge that, FBF may publish on the Game Website or at any other location, details of Participants including the School syndicate name and geographic location.
4.6 Coordinating Teachers consent to receiving newsletters and other information in electronic or other format, in relation to the Game from the FBF or from any third party on behalf of the FBF. Coordinating Teachers acknowledge that the newsletters may, from time to time, contain information that advertises or promotes, or offers to supply, goods or services of the FBF or any third party. Coordinating Teachers may unsubscribe from such newsletters or information at any time by utilising the unsubscribe facility provided with the newsletters or information.
4.7 Coordinating Teachers and Participants acknowledge that Participants' personal information may be disclosed to the Sponsor for purposes related to the Game.

5. Technical requirements

5.1 To play the Game, Browsers must be configured to accept Cookies and enable Java Script.
5.2 Participants acknowledge that the security level for their browsers may need to be set to the standard medium level or lower in order to access the Game. Computers installed with firewall, anti-virus protection or other security protection programs may also require configuration changes in order to access the Game. The FBF is not obliged to assist with the configuration of individual computer settings or security software.
5.3 To view the Help section, browsers such as IE 6 on XP, with pop-up control must allow the Game pages to be displayed.

6 Hypothetical cash and items

6.1 Participants will each commence the Game with a theoretical AUD$XXXX with which to purchase items and make financial decisions. Surplus funds may be left as 'cash-on-hand'.
6.2 FBF reserves the right to amend a Participant's 'cash-on-hand' funds if any errors occur. The FBF accepts no liability or responsibility for any loss or damage from any error or the correction of any errors.
6.3 All monies, items purchased, sold or gained, jobs and events planned as a result of playing ESSI Money are not real and will not be substituted for such by the developers or sponsors.
